Decades of tobacco industry documents show how the tobacco industry has deliberately targeted Black Americans with menthol cigarettes and flavored cigars, as well as LGBTQ+ and limited-income communities. Menthol flavoring makes it easier to start smoking and harder to quit. Ensuring that more people smoke and fewer people quit means more money in Big Tobacco’s pockets.

ACS CAN urges the Food and Drug Administration (FDA) to implement a comprehensive and swift prohibition on menthol in cigarettes and all flavors in cigars. Additionally, ACS CAN will continue to advocate for the prohibition of all flavors in all tobacco products at all levels of government until they are no longer available to addict new consumers. Any flavored product left on the market will allow Big Tobacco to continue to target youth, communities of color, the LGBTQ+ community and others with its deadly products.

Public health and civil rights advocates celebrate the revival of the effort to end the sale of menthol cigarettes in New York City, coming later today when City Councilmember Rita Joseph will introduce legislation to reduce the heavy toll of menthol cigarettes on New Yorkers’ lives and lungs. Intro 1152 would prohibit the more than 5,000 licensed tobacco retailers in New York City from selling menthol cigarettes. The legislation is being championed by No More Menthols NYC-- a diverse, citywide campaign of civil rights and health advocates, including community groups, faith leaders, public health organizations and others.

Menthol Cigarettes and Flavored Cigars Resources

ACS CAN calls on the administration to finalize FDA’s rules to prohibit the sale of menthol cigarettes and flavored cigars immediately. There is no scientific rationale for permitting any flavored tobacco product to remain on the market. To end cancer as we know it for everyone, tobacco use must be addressed and cannot be done without prohibiting the sale of menthol flavors and all flavored cigars.

While overall smoking rates have declined in recent years, smoking rates remain higher among specific subpopulations, including African Americans. These differences are in large part due to the tobacco industry’s targeted marketing through advertising, price discounting and other strategies.
