How You Can Help Hold Big Tobacco Accountable
Nearly 20 years ago, a U.S. Federal District judge found that the major cigarette manufacturers violated civil racketeering laws for deliberately defrauding the public.
ACS and ACS CAN, along with other health partners, filed a friend of the court brief in the Court of Appeals for the Sixth Circuit to help uphold critical tobacco control advertising restrictions contained in the Family Smoking Prevention and Tobacco Control Act (FSPTCA). Our brief argues that the court cannot consider the legal questions about the constitutionality of the restrictions without understanding the public health imperative that lies at the heart of the law. The Act was enacted to stem the constant tide of severe and often deadly health problems caused by tobacco use. Our brief cites the grim statistics associated with tobacco-related illness that justify the restrictions, and argues that the Food and Drug Administration may properly limit the way tobacco may be advertised.
