Statement of Confidentiality

All recipients of this document must treat this Request for Proposal (RFP) as confidential and must not disclose it to any party other than the recipients’ employees on a need to know basis, or other individuals authorized under a written Confidential Disclosure Agreement signed by ACS CAN and the recipient. If the recipient does not agree with these provisions, this RFP must be immediately returned.


 

1.0  American Cancer Society Cancer Action Network Overview

ACS CAN, the nonprofit, nonpartisan advocacy affiliate of the American Cancer Society, supports evidence-based policy and legislative solutions designed to eliminate cancer as a major health problem.  ACS CAN works to encourage elected officials and candidates to make cancer a top national priority.  ACS CAN gives ordinary people extraordinary power to fight cancer with the training and tools they need to make their voices heard.

Our 2016 legislative agenda in New York State will include but not be limited to the following:

  • Cancer Screening - Protecting and maintaining funding for the Cancer Services Program to help uninsured residents obtain recommended cancer screenings; Extending paid sick leave for all public employees (including NYC) to receive cancer screenings as recommended by their doctor.
  • Skin Cancer- Protecting against skin cancer by increasing the age for indoor tanning.
  • Obesity and the cancer connection- Improving access to healthy foods in underserved communities. Enacting policies to promote healthy eating and physical activity.
  • Tobacco Control- Helping residents quit smoking and keeping kids from smoking by increasing funding for the state’s Tobacco Control Program;  Eliminating gaps in Medicaid smoking cessation coverage; Enacting legislation to ensure SUNY College campuses are tobacco free; Increasing the purchase age for tobacco to 21. Including e-cigarettes in the state’s Clean Indoor Air Act.
  • Access to Care - Improving access to needed medications by allowing for substitution of interchangeable biosimilar drugs, permitting less expensive versions of brand drugs to be substituted, while keeping patient safety as the top priority; Improving access to needed medication by providing limitations on fail first (Step Therapy) policies; Allowing pharmacists to administer the HPV Vaccine; Expanding palliative care programs and education.

 

 

2.0  RFP Goals and Objectives

The primary objective of this Request for Proposal (RFP) is to solicit proposals to for an annual lobbying and legislative consulting contract in New York, which may include any of the following:

  • Scheduling and attending meetings with state legislators, administration officials, and others as needed. Work toward a lobbying goal of conducting face to face meetings with all relevant legislators, and others, total numbers to be determined
  • Track and submit weekly review of relevant introduced legislation to NYS Government Relations Director.
  • Assist with annual Day at the Capitol preparations including messaging and scheduling meetings.
  • Recommend steps to include ACS CAN priorities within other legislation, including the budget.
  • Help coordinate recruitment of allied organizations that have their own lobbyists.
  • Monitor the introduction or amendment of regulations that could impact cancer.
  • Participate and assist in coordinating advocacy events, such as issue specific educational and awareness events, and press conferences.
  • Assist in development of materials and letters utilized for legislative meetings.
  • Assist in building relationships with organizations that have similar goals as ACS CAN which may include statewide advocacy organizations, corporations, and organized labor organizations.
  • Provide guidance on compliance with all state and local laws relating to lobbying activities and required reporting; submit all required lobbying reports to the state and local government agencies, including New York City.

                 

3.0  Instructions/Process for RFP

3.1    Questions Regarding the RFP

If you have questions pertaining to this RFP, send an e-mail to [email protected] prior to the due date.  Be sure to include a phone number and Email address and specifically reference the section of the RFP in question.  All questions must be in writing.  Questions and answers may be given to all participating vendors in order to avoid any unfair advantage.  These guidelines for communications have been established to ensure a fair and equitable evaluation process for all respondents.  Any attempt to bypass the above lines of communication may be perceived as establishing an unfair or biased process and could lead to your disqualification as a potential vendor.

3.3    Response Costs

All costs associated with the preparation of a Proposal shall be borne by the Vendor.

3.4    Confidentiality

This RFP and any information supplied in connection with the preparation of a Proposal is confidential and must not be disclosed, reproduced, or used in any way, except for the sole purpose of responding to this RFP.

3.5    Selection Process

ACS CAN evaluation team members will evaluate each proposal based upon how it satisfies ACS CAN’s requirements.  Consideration will be made of:

  • The proposed level of service and performance standards
  • Demonstrated knowledge of legislative process
  • Cost to value ratio
  • Vendor industry reputation and experience

 

While cost will remain a critical decision factor, quality, level of service and operating efficiencies that will be realized by ACS CAN are the primary and the most critical aspects.  Please be sure to include all essential data in the proposal to ensure ACS CAN has a full and complete understanding of the Vendor’s capabilities and experience. 

3.6    Schedule of Events

Selected firms will be contacted for an interview prior to December 15th with an anticipated contract start date of January 1, 2016.

4.0  Proposal Contents

Your proposal must identify each of the following numbered sections by repeating the question or statement and then clearly indicating your response directly below.  In cases where a question/statement does not apply, or you are unable to respond, reference the question followed by "N/A" (Not Applicable) and briefly explain the reason for not responding.  Vendor may add items not listed within this section by placing them at the end of the proposal. 

For all of your answers, when applicable, please indicate whether you are presently using the methods or proposed approaches that you have described or whether you will implement these methods upon award of the bid.

5.0    Minimal Contract Requirements, if selected

5.1    Tobacco-related affiliation

Assuming that "Tobacco Company" means any company that manufactures tobacco products and is commonly considered to be part of the tobacco industry, including subsidiaries and parent companies, as well as philanthropic foundations and other organizations closely linked with the tobacco industry, please respond to the following:

5.1.1    Do you own 5% or more of a Tobacco Company?

5.1.2    Are you 5% or more owned by a Tobacco Company?

5.1.3    Are any of your clients Tobacco Companies?  

5.1.4    If so, how many and what percentage of your revenues are derived from those clients?

5.1.5    Will you and your employees adhere to ACS CAN's no smoking policy when on ACS CAN premises?

5.2    Conflict of Interest

5.2.1    Are any of your employees, officers or majority owners employed by or national volunteers of ACS CAN or the American Cancer Society, Inc. (a national volunteer shall mean an ACS CAN or ACS board member)?

5.2.2    Are you able to state that your company will not enter into a contract or agreement, or execute a document, which will create a conflict of interest or which will prevent you from freely performing for ACS CAN?

 

5.3    Intellectual Property

Any materials produced under this agreement will be performed as “work for hire” and ACS CAN will have ownership of the deliverables.  Vendors must include in their proposals a statement indicating their understanding that all deliverables under this contract is work performed for hire.
